The rules that govern your use of Aser One and its related services.

These Terms & Conditions (the “Terms”) form an agreement between you — the person or business that subscribes to or uses the service (“you”, “Customer”) — and ASER Technologies, a company incorporated in Burundi with its registered office at UMUCO Coworking Space, Avenue des États-Unis No. 76, Kigobe-Sud, Ntahangwa, Bujumbura, Burundi (“ASER”, “we”). By creating an account, ticking the acceptance box, or using Aser One, you agree to these Terms. If you do not agree, do not use the service.

1. Definitions

“Aser One” means ASER's business management software suite (web and mobile apps, the Services, Retail, Restaurant, Hotel and other editions), together with related features, updates and services. “Customer Content” means the data you enter, import or generate through the service (customers, invoices, stock, accounting, etc.). “User” means any person you authorise to access your account.

2. The service

ASER grants you a non-exclusive, non-transferable, revocable right to access Aser One on a software-as-a-service (SaaS) basis, for your internal business purposes, for the duration of your subscription. The service is provided “as is” and evolves over time: we may add, change or remove features.

3. Accounts & eligibility

  • You must have the legal capacity to enter into a contract and, where relevant, authority to bind the business you represent.
  • You are responsible for the accuracy of the information you provide, for keeping your credentials confidential, and for all activity under your account.
  • Notify us immediately of any unauthorised access at info@aser-tech.com.

4. Subscriptions & billing

  • Pricing & cycles. Paid subscriptions are billed in advance, per cycle (monthly or yearly), based on the plan and number of users chosen. Prices are exclusive of applicable taxes unless stated otherwise.
  • Auto-renewal. Unless cancelled before the end of the current cycle, your subscription renews automatically for an equal period at the then-current price.
  • Taxes. You are responsible for all taxes, duties and levies applicable to your subscription.
  • Late payment. If payment fails, we may suspend access after reasonable notice.
  • Price changes. We may change our prices; any increase takes effect at the next cycle, after prior notice.
  • Refunds. Refunds are governed by our Refund Policy.

5. Free plan & trials

The free plan and trial periods are provided as is, with no commitment as to availability or support, and may be limited, changed or withdrawn at any time. They are intended for good-faith evaluation.

6. Acceptable use

Your use of Aser One is subject to our Acceptable Use Policy. Any breach may lead to suspension or termination of your account.

7. Your data & responsibilities

  • You remain solely responsible for Customer Content: its accuracy, lawfulness, quality and the rights needed to process it.
  • You warrant that you have all required permissions to enter into Aser One the data of your own customers, employees and suppliers.
  • The processing of personal data is described in our Privacy Policy.
  • Backups. We take reasonable backups, but we recommend you keep your own exports. We do not guarantee the complete absence of data loss.

8. Tax compliance (OBR / EBMS)

Important. Aser One provides tools that help with invoicing and the transmission of data to the tax authority (for example OBR / EBMS in Burundi). Your business's tax, accounting and regulatory compliance is your sole responsibility. ASER is not liable for any fines, penalties, reassessments or disputes arising from your declarations, from incorrect data, from the unavailability of a third-party service, or from a change in regulation.

9. Third-party services

Aser One may connect with third-party services (mobile money such as M-Pesa or MTN MoMo, tax platforms, messaging such as WhatsApp, carriers, hosting and AI model providers). These are provided by third parties under their own terms. ASER does not control their operation and disclaims liability for their unavailability, errors, delays or changes.

10. AI features

AI features are governed by our AI Terms. AI output is provided for guidance only and must be verified before any decision.

11. Intellectual property

Aser One, its code, design, trademarks and documentation are and remain the exclusive property of ASER Technologies. All rights reserved. Nothing in these Terms transfers any ownership in the service to you. You retain all rights in your Customer Content and grant us a limited licence to host and process it in order to provide the service.

12. Availability & support

We strive for a reliable service but do not guarantee uninterrupted availability on standard plans. Interruptions may occur for maintenance, updates or causes beyond our control. The level of support depends on your plan; a service-level commitment (SLA) is offered only under Enterprise or custom plans that expressly provide for one.

13. Disclaimer of warranties

The service is provided “as is” and “as available”, without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, continuity or freedom from error. ASER does not warrant that the service will meet all your needs or operate without interruption or defect.

14. Limitation of liability

To the fullest extent permitted by law, ASER shall not be liable for any indirect, incidental, special or consequential damages, nor for any loss of profits, revenue, goodwill, data, opportunity or anticipated savings, even if advised of the possibility.

ASER's total aggregate liability, on any basis, is limited to the amount you actually paid for the service in the three (3) months preceding the event giving rise to the claim. For the free plan and trials, such liability is limited to a nominal amount equivalent to BIF 50,000.

15. Indemnification

You agree to defend, indemnify and hold harmless ASER, its officers, employees and partners against any claim, loss, damage, fine or cost (including reasonable defence costs) arising from: (a) your Customer Content; (b) your use of the service in breach of these Terms or the law; (c) failure to meet your tax or regulatory obligations; or (d) infringement of a third party's rights.

16. Suspension & termination

  • You may terminate at any time; termination takes effect at the end of the current cycle, with no refund of the started cycle (see Refund Policy).
  • We may suspend or terminate your access, with reasonable notice where possible, for non-payment, breach of these Terms, a security risk or a legal obligation.
  • On termination, your right to use the service ends. We make your Customer Content available for export for a reasonable period (at least 30 days), after which it may be deleted.

17. Changes

We may change the service and these Terms. For material changes, we will notify you by a reasonable means (email or in-product notice). Continued use after the effective date constitutes acceptance.

18. Force majeure

ASER is not liable for any failure caused by an event beyond its reasonable control: power or network outage, third-party provider failure, natural disaster, conflict, act of authority, or any other force majeure.

19. Governing law & disputes

These Terms are governed by the laws of Burundi. Failing amicable resolution within thirty (30) days of written notice of the dispute, the competent courts of Bujumbura, Burundi shall have exclusive jurisdiction, without prejudice to mandatory consumer-protection rules.

20. General

  • Entire agreement. These Terms, together with the policies they reference, constitute the entire agreement between the parties.
  • Severability. If a clause is held invalid, the remaining clauses continue to apply.
  • Waiver. Failure to exercise a right is not a waiver of that right.
  • Assignment. You may not assign this contract without our written consent; we may assign it in connection with a reorganisation or asset transfer.
  • Notices. Notices to us are sent to info@aser-tech.com.
